You will have some rights when paying with Paypal. Set up a Claim in the resolution centre and the seller will need to prove that he posted the item or issued you a refund.
It's happened to me in role reversal; over 1 month later a buyer put in an claim to say they had not received what they bought from me. I always keep the pdf file from the courier. It showed an DHL order number and that I had sent the item to their registered paypal address. Case closed.
So if proof of posting isn't present, you'll win and receive a refund whether they have the funds or not. Paypal will just give their account a negative balance.
