the old mot is deffinatly still valid.

but if your driving around with the defects still there, then you can be done for driving a un-roadworthy vehicle.

Im not so sure about that.

    Note 1 states:

This document tells you that your vehicle has not been shown to meet the minimum legal requirements for the reasons detailed in section A. If you intend to use your vehicle on the road you should have it repaired without delay and have it retested BEFORE THE EXISTING TEST VALIDITY EXPIRES.

This to me suggests that your old mot is still valid until its expiry date (unless the existing test validity is the 10 day period being the maximum time between a test & retest.

Note 2 appears to apply if the old mot has expired.

    Can ayone verify?

i have already verified, your mot is valid until the expiry date, but you cannot drive an unroadworthy vehicle.

That suggests that if your car fails an mot it is unroadworthy & therefore any remaining mot on the original mot certificate is therefore invalid. This surprises me as i would have thought a garage would warn you of this when driving away after a failed mot. The MOT failure sheet is unclear & seems more down to interpretation rather than actual clear fact.

I always thought that you could still use the car after a failed mot until the old certificate expired so thanks for the advice I know better now!

    Checked pm's and replied!
What if I didn't take it for a test until after my current mot ran out? Surly there are millions of cars on the road that have a valid mot but would fail the next.
I'm only driving 4miles a day in it until I buy another car or the mot runs out.

You are right in what you say that there are many cars on the road that are unroadworthy. However, one major issue on this subject is insurance. There is a big difference between driving an unroadworthy car & knowing about it & driving one & not knowing. If an insurance company could find out that your car failed an MOT i guess it may invalidate your cover. I dont know if this is definately the case but may be worth checking.

your cars mot till the mot runs out, it can faill 300times in a year and still be mot'ed, your current mot is only void if you pass.

dodgey mot places will fail every car they have in for a service ect, so that there stats to vosa look normal without you ever knowing

but it is ilegal to drive a unroadworthy car

Jack, why would a garage failing a car look normal to Vosa? Just curious
